Acceptable Use Policy

American Wide Broadband, Inc.

1. Purpose and Scope

American Wide Broadband, Inc. (“AWB,” “we,” “us,” or “our”) provides internet access, managed network, and related communications services (the “Services”) to residential, multifamily, commercial, and hospitality customers throughout the Chicagoland area.

This Acceptable Use Policy (this “Policy”) describes conduct that is prohibited on or through the AWB network, regardless of the type of Service purchased or the service plan under which it is delivered. This Policy applies to:

  • every customer, subscriber, or account holder of any AWB Service (“you” or “Customer”);
  • every property owner, manager, or operator receiving Services under a bulk, right-of-entry, or commercial agreement;
  • every resident, tenant, guest, employee, contractor, or other person who accesses the AWB network through a Customer’s account or premises (collectively, “Users”); and
  • every device connected to the AWB network.

Customer is responsible for the acts and omissions of all of its Users, and for ensuring that its Users comply with this Policy.

2. Relationship to Your Service Agreement

This Policy governs conduct only. It does not define, modify, expand, or limit the technical or commercial terms of any Service.

Matters such as bandwidth or data allowances, speed tiers, IP address assignment (dynamic or static), permitted server or hosting activity, permitted business or commercial use, resale rights, equipment, pricing, billing, dispute windows, fees, service levels, and term and termination rights are governed exclusively by the agreement, tariff, service order, or terms of service applicable to your particular Service (your “Service Agreement”).

In the event of any conflict or inconsistency between this Policy and your Service Agreement, your Service Agreement controls as to the conflicting term. Nothing in this Policy shall be construed to:

  • (a) impose a data allowance, usage cap, or throughput limitation on any Service where the applicable Service Agreement does not impose one;
  • (b) prohibit business, commercial, or non-personal use of any Service where the applicable Service Agreement permits it;
  • (c) prohibit the operation of servers, static IP addressing, or hosting where the applicable Service Agreement permits it; or
  • (d) create any right, remedy, notice period, or fee not set forth in the applicable Service Agreement.

Conversely, nothing in this Policy limits any restriction, allowance, or obligation that your Service Agreement does impose. Residential and commercial Services are subject to the AWB Agreement for Residential Services & Applicable Business Broadband Commercial Services, available at www.awbworld.com/service-agreement/, and to any separately executed agreement, service order, or addendum applicable to the particular Service. Where a separately executed agreement applies, that agreement controls.

3. Prohibited Uses

You and your Users may not use the Services, directly or indirectly, to engage in any of the following.

3.1 Unlawful Activity

  • Violating any applicable federal, state, or local law, regulation, or ordinance, or any applicable law of a foreign jurisdiction.
  • Transmitting, storing, distributing, or facilitating access to material that is unlawful, including material that violates export control, sanctions, gambling, securities, or controlled-substance laws.
  • Transmitting, receiving, storing, or making available child sexual abuse material or any material that sexually exploits a minor. AWB reports such material to the National Center for Missing & Exploited Children and to law enforcement as required by law.
  • Engaging in fraud, phishing, identity theft, money laundering, pyramid or Ponzi schemes, or the sale of stolen credentials or data.

3.2 Intellectual Property Infringement

  • Uploading, downloading, posting, transmitting, reproducing, or otherwise making available any material that infringes a copyright, trademark, patent, trade secret, right of publicity, or other proprietary right.
  • Circumventing or providing tools to circumvent technological protection measures.

3.3 Harmful, Abusive, and Threatening Conduct

  • Transmitting material that is defamatory, harassing, threatening, or that constitutes stalking, doxxing, or an incitement to violence.
  • Transmitting material that is obscene under applicable law.
  • Impersonating any person or entity, or misrepresenting an affiliation with any person or entity.

3.4 Security Violations

  • Accessing, or attempting to access, any account, system, network, device, or data without authorization.
  • Probing, scanning, or testing the vulnerability of any network or system without the express written authorization of its operator.
  • Breaching, or attempting to breach, any authentication, security, or access control measure.
  • Intercepting, monitoring, or capturing data, traffic, or communications not intended for you, including packet capture on shared network segments.
  • Distributing, installing, or executing malware, ransomware, viruses, worms, trojans, keyloggers, botnet clients, cryptominers, or similar malicious code.
  • Using the Services to conduct or facilitate a denial-of-service or distributed denial-of-service attack, whether against AWB infrastructure or any third party.

3.5 Network Abuse and Interference

  • Taking any action that damages, disables, overburdens, degrades, or impairs the AWB network, any AWB equipment, or the ability of other customers or Users to use the Services.
  • Falsifying, forging, or spoofing any TCP/IP packet header, IP address, MAC address, email header, or other identifier, or otherwise concealing the origin of transmitted data.
  • Using any IP address not properly assigned to you by AWB, or reconfiguring AWB-assigned addressing without authorization.
  • Connecting to the AWB network any device or software that interferes with AWB’s network management, monitoring, or provisioning systems.
  • Operating a rogue DHCP server, unauthorized DNS server, or unauthorized routing announcement on the AWB network.
  • Operating a wireless access point, repeater, mesh node, or other radio transmitter on the 2.4 GHz, 5 GHz, or 6 GHz bands that causes harmful interference to AWB’s managed wireless network at a property served by AWB, or intentionally jamming, deauthenticating, or degrading AWB wireless service.
  • Tampering with, relocating, obstructing, damaging, opening, or attempting to service AWB-owned equipment, cabling, conduit, antennas, radios, enclosures, or demarcation points.
  • Bypassing or attempting to bypass any authentication portal, bandwidth allocation, port assignment, VLAN segmentation, or other network control implemented by AWB.

3.6 Messaging Abuse

  • Sending unsolicited bulk or commercial electronic messages (“spam”), including email, SMS, instant messages, or similar communications, whether or not the recipient is an AWB customer.
  • Sending messages in violation of the CAN-SPAM Act, the Telephone Consumer Protection Act, or any comparable law.
  • Operating an open mail relay, open proxy, or open recursive resolver.
  • Harvesting or scraping email addresses or contact information for the purpose of sending unsolicited messages.
  • Sending mail with forged, invalid, or misleading headers or return paths.

3.7 Unauthorized Resale or Redistribution

You may not resell, sublicense, redistribute, or otherwise make the Services available to any third party for a fee or other consideration, except to the extent expressly permitted by your Service Agreement or by a separate written agreement with AWB. Nothing in this Section restricts a property owner, manager, or operator from providing Services to its residents, tenants, or guests where its Service Agreement contemplates that arrangement.

4. Network Management

AWB employs reasonable network management practices to maintain the integrity, security, and performance of its network for all customers. These practices may include monitoring aggregate traffic patterns, mitigating attacks and abuse, filtering traffic associated with malware or spoofed addressing, blocking ports commonly used to propagate abuse, prioritizing management and voice traffic, and taking action against devices exhibiting abusive behavior.

Network management practices are applied for technical and security purposes. They do not create, and shall not be interpreted as creating, any usage allowance, cap, throttle, or service limitation beyond those expressly set forth in your Service Agreement. AWB does not impose a monthly data cap or usage allowance on its Services.

AWB publishes information about its network management practices as required by applicable law and regulation.

5. Copyright and DMCA Notices

AWB responds to notices of alleged copyright infringement in accordance with the Digital Millennium Copyright Act, 17 U.S.C. § 512. Notices of alleged infringement should be directed to AWB’s designated agent:

A valid notice must include the elements required by 17 U.S.C. § 512(c)(3). AWB will forward notices to the responsible Customer or User where AWB can identify them, and maintains a policy of terminating, in appropriate circumstances, the accounts of subscribers who are repeat infringers.

Counter-notifications may be submitted to the same agent and must include the elements required by 17 U.S.C. § 512(g)(3).

6. Reporting Violations

Report suspected violations of this Policy, network abuse, spam, or security incidents to:

Please include full message headers, log excerpts with timestamps and time zone, source and destination IP addresses, and any other detail that will help AWB identify the activity.

7. Enforcement

7.1 AWB’s Rights

AWB may, but is not obligated to, investigate any suspected violation of this Policy. Where AWB determines in its reasonable discretion that a violation has occurred or is occurring, AWB may take any one or more of the following actions:

  • (a) issue a warning to the Customer or User;
  • (b) block, filter, rate-limit, quarantine, or reroute the offending traffic, device, port, or address;
  • (c) remove or disable access to offending material stored on AWB systems;
  • (d) suspend the affected Service, account, device, or port, in whole or in part;
  • (e) terminate the Service or account; and
  • (f) refer the matter to law enforcement or to affected third parties.

7.2 Proportionality and Notice

AWB will, where circumstances reasonably permit, provide notice and an opportunity to cure before suspending or terminating a Service. AWB may act immediately and without prior notice where the activity presents a risk to the security, integrity, or availability of the network, exposes AWB or others to legal liability, involves child sexual abuse material, or where notice is otherwise impracticable.

7.3 Procedural Rights Preserved

Any suspension or termination of a Service under this Policy remains subject to the notice, cure, and termination provisions of the applicable Service Agreement. This Section 7 does not shorten any cure period, eliminate any notice requirement, or create any termination right that the applicable Service Agreement does not provide.

7.4 No Waiver

AWB’s failure to enforce this Policy in any instance is not a waiver of its right to enforce it in any other instance.

8. No Duty to Monitor

AWB does not monitor, review, edit, or exercise editorial control over the content transmitted, stored, or accessed by Customers or Users, and assumes no responsibility or liability for such content. AWB acts as a conduit for communications. Nothing in this Policy obligates AWB to monitor any Customer or User, and AWB’s exercise or non-exercise of any right under this Policy creates no duty to any Customer, User, or third party.

9. Privacy

AWB’s handling of customer information is governed by the AWB Privacy Policy, available at www.awbworld.com/privacy-policy/, and by applicable law, including 47 U.S.C. § 551. AWB may access, preserve, and disclose account information and traffic data where reasonably necessary to comply with law or legal process, enforce this Policy, respond to claims of infringement, protect the rights, property, or safety of AWB, its customers, or the public, or investigate suspected fraud or abuse.

10. Changes to This Policy

AWB may revise this Policy from time to time. The current version will be posted at www.awbworld.com/AUP/. Revisions take effect upon posting, except that a revision materially expanding a Customer’s obligations takes effect thirty (30) days after posting as to that Customer. Continued use of the Services after the effective date of a revision constitutes acceptance of the revised Policy. Where a Customer’s Service Agreement specifies a different mechanism for amending policies incorporated into that agreement, that mechanism controls.

11. Severability

If any provision of this Policy is held unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall remain in full force and effect.
